Oshi Health, Inc. (“Oshi”, “us” or “we”) is committed to protecting your privacy. Through our mobile application (the “App”), Oshi provides a platform for you to track your inflammatory bowel disease symptoms, empowering you to better understand and manage your health. This Privacy Policy describes how we collect, use and disclose information through the App, our website (the “Website”), and related services (collectively, the “Services”).


Please read this Privacy Policy carefully. By accessing, downloading, or using any of the Services, you agree that you are bound by the Oshi Terms of Use and Privacy Policy. IF YOU DO NOT AGREE TO THE TERMS OF USE AND THE PRIVACY POLICY, INCLUDING ANY CHANGES THERETO, THEN YOU MUST NOT ACCESS AND USE THE SERVICES.


The Services are not intended for use by any individual under the age of 13. If you are under the age of majority in your jurisdiction, your parent or guardian must review and agree to be bound by Privacy Policy on your behalf prior to your use of the Services.

Oshi does not knowingly collect or solicit Personal Information from anyone under the age of 13 or knowingly allow such persons to register on the Services. If we learn that we have collected Personal Information from anyone under the age of 13, we will use commercially reasonable efforts to delete that information.

If you are the parent or guardian of a minor child who has provided us with Personal Information, you may contact us using the information below to request it be deleted.


Information We Collect From You

When you register with the Services, we collect certain personally identifiable information about you (“Personal Information”), including your name, e-mail address and password. Once you have registered, we may collect the following information about you, including:

  • Your birthdate and certain health information, e.g., your diagnosis and how long you have been having symptoms.
  • Information you provide to us when you access or use the Services.
  • Information you provide in public forums through the Services, including using our review, comment, post or similar functionality.

Information We Collect Automatically

We may collect certain information when you use the Services, including the following:

  • Use of the App. When you use the App, we may collect certain information about such use, including the location of your mobile device, your mobile device ID, type of device and operating system you use to access our App; your activities within the App; and the length of time that you are logged in through the mobile app.
  • Unique Identifiers. We may collect certain information through unique identifiers such as IP address when you are using the Services.
  • Cookies. We may use “cookies” and other technologies to collect data that enable us to better understand and improve the usability, performance and effectiveness of our Services. For instance, we may use session cookies (which expire once you close your browser) or and persistent cookies (which stay on your mobile device until you delete them) to provide you with a more personal and interactive experience on our App.
  • Third-Party Analytics. We use third parties’ analytic and tracking tools to better understand who is using the Services, how people are using the Services and how to improve the effectiveness of the Services and its content, and to help those parties serve more targeted advertising to you across the Internet or help us serve more targeted advertising to you. Those third party companies may use cookies, pixel tags or other technologies to collect and store anonymous information such as time of visit, pages visited, time spent using the Services, device identifiers, type of operating system used and other website(s) you may have visited. They might combine information they collect from your interaction with the Services with Personal Information they collect from other sources. We do not have access to, nor control over, third parties’ use of cookies or other tracking technologies.
  • Geo-Location. We do not collect any information regarding your real-time geo-location while using the Services. We may, however, do so at some point in the future. We will request your permission before collecting such information.
  • DNT. Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. Oshi and the Services do not recognize DNT.


Oshi may use your information for the following purposes:

  • To provide you with the Services, including administering your Oshi account.
  • To communicate with you about your account or transactions with us and send you information about features of the Services or changes to our policies.
  • To personalize content and experiences and advertising.
  • To detect, investigate and prevent activities that may violate our policies or be illegal.
  • To optimize or improve the content, products, services, and features of the Services.
  • To personalize and improve the Services and user experiences, to increase the functionality and user friendliness of the Services, to deliver content or features that match user profiles or interests.
  • To monitor and analyze the Services usage and trends and otherwise measure the effectiveness of the Services.

Oshi may also send you offers and promotions for our products and services. We will give you an option to opt-out of future promotional messages of this nature, although you may still continue to receive service-related messages which are not promotional in nature, such as messages to assist you in recovering your password, notify you of changes to our policies, or assist you with other customer service requests.


We will not share your Personal Information with third parties except as described in this Privacy Policy. We may share your Personal Information:

  • When you allow us to share your Personal Information with another company, such as directing us to share your Personal Information with third-party sites or platforms, such as social networking sites.
  • When we contract or partner with a third party to provide services on our behalf, including to assist us in the development, operation and maintenance of the Services. We require all such third parties to process your data in accordance with this Privacy Policy.
  • When we share Personal Information with third parties in connection with the sale of a business (including merger, acquisition, or sale of all or a material portion of its assets, change in corporate control, or insolvency or bankruptcy proceedings), to enforce our Terms of Use or rules, to ensure the safety and security of our users and third parties, to protect our rights and property and the rights and property of our users and third parties, to comply with legal process, including judicial warrant, rule, order or subpoena or in other cases if we believe in good faith that disclosure is required by law or regulation.

In addition, we may share aggregate information with third parties, however such aggregate information will not contain Personal Information.


If you use a message board, comment function, or other public or semi-public venue of the Services, you will be identified on those venues by the username or other registration information you submit. To the extent you submit a question via the Q&A feature, the content of your question may be made public by a moderator, although we will not include your username, and you will remain anonymous.

Information you provide on public or semi-public venues may also be viewable by other users of the Services. We cannot be responsible for any Personal Information you choose to post on public or semi-public venues and we recommend careful consideration before you post such information.


You may exercise certain controls and choices regarding our collection, use and sharing of your information, or request access to your Personal Information, by modifying your profile or by contacting us at support@oshihealth.com or following instructions provided in communications sent to you. Please be aware that, if you do not allow us to collect Personal Information from you, we may not be able to deliver certain products and services to you, and some of our services may not be able to take account of your interests and preferences. If you have questions regarding the specific Personal Information about you that we process or retain, please contact us at support@oshihealth.com.

When you access the App, you may be asked whether you will allow us to access your location while you are not using the App and/or whether you would like to receive notifications on your mobile device. If you choose to “allow” this, but then would later like to opt-out, you may do so by updating the privacy settings on your mobile device.


Our Services may contain links to other sites operated by third parties. Oshi does not control such other sites and is not responsible for their content, their privacy policies, or their use of Personal Information. Oshi’s inclusion of such links does not, by itself, imply any endorsement of the content on such sites or of their owners or operators except as disclosed on the Services. Oshi expressly disclaims any and all liability for the actions of third parties, including but without limitation to actions relating to the use and/or disclosure of Personal Information by third parties. Any information submitted by you directly to these third parties is subject to that third party’s privacy policy.


The security, integrity and confidentiality of your information are important to us. We have implemented technical, administrative, and physical security measures that are designed to protect user information from unauthorized access, disclosure, use and, modification. From time to time, we review our security procedures to consider appropriate new technology and methods. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable. We will retain your Personal Information for the length of time needed to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required, or for the establishment, exercise or defense of legal claims, or for legitimate businesses purposes, or as provided by law.


We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on the App or on the Website prior to the change becoming effective, and by updating the Last Revised date at the top of this Privacy Policy. We encourage you to periodically review this page for the latest information on our privacy practices.


California Civil Code Section § 1798.83 permits users that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, you may contact us by e-mail at support@oshihealth.com.


The Services and the servers upon which the Services are hosted are located in the United States and are intended only to be used by individuals in the United States. Personal Information you submit using the Services will be transferred to and stored in the United States. By using the Services and submitting Personal Information, you authorize this transfer.


Any questions or concerns regarding the use or disclosure of Personal Information should be directed to Oshi Health, Inc. at support@oshihealth.com. Oshi Health, Inc. will investigate and attempt to resolve complaints and disputes regarding use and disclosure of Personal Information in accordance with the principles contained in this Privacy Policy and the Terms of Use.

If Oshi Health, Inc. is unable to resolve your complaint, you can escalate the issue in accordance with the dispute resolution procedure set out in the “Arbitration and Class Action Waiver” section of the Terms of Use.
