Oshi Health Inc (“we”, “our”, or “us”) is committed to protecting the privacy of personal information. This Privacy Policy (this “Policy”) applies to your use of our website available at www.oshihealth.com, any sub-pages, and any related services or applications maintained or accessible through our website (collectively, the “Site”). This Policy also describes how we collect and use information through the Site.

This Policy does not apply to information created or collected by the physicians or other healthcare providers that we contract with, including Integrative Digestive Partners, P.A. (“IDP”) and IDP Affiliated Covered Entity (collectively, the “Group”). Rather, the use and disclosure of such information is governed by this Notice of Privacy Practices. This Policy also does not apply to information created or collected by any third party, including through any application or content that may link to or be accessible from or on the Site. 

By using the Site, you agree to the terms of this Policy, and consent to the collection and use of personal information about you as described in this Policy. If you do not consent to the contents of this Policy, you may not use the Site.

This Site is not designed or intended to appeal to minors and we do not knowingly collect personal information from children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at support@oshihealth.com, so we can promptly delete that information.

2. CHANGES TO THIS POLICY

We reserve the right to modify this Policy at any time. The effective date of the current version of this Policy will be posted at the top of this page. It is your responsibility to review this Policy periodically. If we modify this Policy, we will post the modified version to the Site. By continuing to access or use the Site, you indicate that you agree to be bound by the modified Policy.

3. INFORMATION WE RECEIVE

By using this Site, you agree that you are providing any information that we collect voluntarily and with your consent. Information that we collect about you may include your name, contact details, or information about the device that you use to access the Site. If you navigated to this Site through a link provided through third-party social media (such as Facebook or LinkedIn), that social media provider may provide us with additional information related to your account with that provider. The information that we obtain from any social media provider is governed by that provider’s terms of use and privacy policy.

Government Authorities:  We may share information collected through the Site in order to comply with our legal obligations, or if we believe, in good faith that such disclosure is necessary to comply with a subpoena, warrant, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a valid government request.

Business Transfer:  In the event that we are involved in a corporate merger, sale, acquisition, dissolution, bankruptcy or other transfer of all or a portion of our assets, we may share information collected through the Site with the third party(s) involved in the transaction.

Aggregated Data: We may disclose aggregated, anonymized data without limitation for any business purpose.

We may also disclose your information for purposes to which you have consented or for the purposes we describe at the time you provide the information. We may also disclose your information to protect or enforce our rights or obligations under the Terms.

We do not make any guarantee with respect to the security or privacy of information collected through the Site.

If you are a resident of the State of California, you may have certain rights governed by the California Consumer Privacy Act of 2018, as amended, and its associated regulations (“CCPA”). This includes the right to contact us to explicitly object to us selling personal information about you to third parties. You understand that this right does not apply to personal information that we share with third parties that are involved in the operation of the Site, or to information that we have collected through the Site that we have de-identified.

We do not specifically market the Site, or our services to individuals outside of the United States. However, we understand that the Site is available worldwide, and as such, some visitors to the Site may reside within the United Kingdom (the “UK”) or the European Union (the “EU”). If you are a resident of the UK or EU, you may have certain rights governed by the EU General Data Protection Regulation (“GDPR”). You understand that we are established in the United States and that we process your personal information in the United States. By using the Site, you consent to your personal information to be transferred from your country of residence to the United States for processing.
